End-of-service gratuity
RD 53/2023 (Art. 61): since 31 July 2023, 1 month's basic wage/yr for ALL years of service, no cap, min 1 year, no reduction on resignation. Service performed BEFORE 31 July 2023 keeps the old tiers (15 days' wage/yr for years 1–3, then 30 days' wage/yr), so a pre-2023 hire needs a split calc. If no hire date is known, assume all service is post-July-2023 (flat 1 month/yr). WAGE BASIS: this award is computed on the last monthly BASIC wage only — allowances are excluded from the base.
- Requires at least 1 year of continuous service
- From 31 July 2023: 1 month's wage per year, for all years
- Service before 31 July 2023: 15 days' wage/year (years 1–3), then 30 days/year
- Partial years are calculated proportionally
- Full gratuity on both resignation and termination (no reduction)
